Terms of Use

This End User License Agreement ("Agreement") defines the legal terms between the individual or entity using the software ("End User") and the Company regarding access and use of the EZcap application and its related features ("Software," "Application," or "Platform"). By downloading, installing, or using the Software, the End User agrees to be bound by the terms set forth herein.
1. Ownership and License Scope
All rights, title, and interest in the Software, including all updates, enhancements, and accompanying documentation, are and shall remain the exclusive property of the Company. The Company grants the End User a limited, non-exclusive, non-transferable license to operate the Software as outlined in this Agreement. No ownership rights are transferred through this Agreement.
2. User Consent and Legal Capacity
Use of the Software constitutes the End User's express acceptance of this Agreement. By proceeding, the End User affirms they possess the legal capacity to enter into binding contracts and agree to comply with all applicable regulations. If any term of this Agreement is unacceptable, the End User must discontinue use and remove the Software from all devices immediately.
3. Software Functionality and Purpose
EZcap is designed as a screen capture utility for Windows desktop environments. The Software enables users to capture screenshots of their screen or selected areas, with options to copy captured images to the clipboard, save them to local storage, or exit the capture mode. All captured content is processed and stored locally on your device.
4. Technical Access and System Integration
System Permissions Required for Functionality
To provide screen capture capabilities, the Software requires specific system-level permissions. These permissions are used exclusively for application functionality and not for data collection or transmission:
- Screen Capture Access: Required to capture screenshots of your display
- Clipboard Access: Required to copy captured images when you select this option
- File System Access: Required to save images to your chosen location when you select this option
- Keyboard/Mouse Input Detection: Required to activate captures using hotkeys or mouse interactions
Important: These permissions enable the Software to function as a screen capture tool. No data accessed through these permissions is collected, transmitted, or shared. All operations occur locally on your device.
System Integration
The Software may create desktop shortcuts and file associations to enhance user experience. Upon uninstalling the Software, these elements are typically removed automatically. In rare cases, you may need to manually remove shortcuts or reset file associations through your system settings, which can be done through standard Windows configuration tools.
5. Grant of License and Use Limitations
The Company grants a revocable, personal license for non-commercial and lawful use of the Software. This license does not permit sublicensing, redistribution, reverse engineering, or unauthorized modification. Any violation, including attempts to tamper with, exploit, or commercially distribute the Software, will result in immediate license revocation and may lead to legal consequences.
6. Third-Party Interactions
The Software operates independently on your local Windows system and does not connect to external servers or third-party services. All screen capture functionality is performed locally. However, the End User acknowledges that captured content may include third-party materials, and the Company assumes no responsibility for the nature, legality, or copyright status of content captured by the End User.
7. Responsibilities of the End User
The End User agrees to refrain from:
- Reproducing, distributing, or altering the Software in any unauthorized manner
- Interfering with built-in security protocols or attempting to bypass software protections
- Using the Software for any purpose that is fraudulent, abusive, or unlawful
- Capturing, storing, or distributing content that violates copyright, privacy rights, or other legal protections
- Using the Software to capture sensitive, confidential, or protected information without proper authorization
- Infringing upon any intellectual property or proprietary rights
- Using the Software in a manner that violates applicable privacy laws or regulations
Violation of these obligations may lead to immediate termination of this Agreement and potential civil or criminal liability.
8. Intellectual Property Rights
The Software incorporates proprietary content protected by applicable laws, including but not limited to copyright, patent, trademark, and trade secret laws. Except for the license expressly granted herein, no other rights are conveyed to the End User. Unauthorized use of any intellectual property associated with the Software is strictly prohibited.
The End User retains all rights to content they capture using the Software, but is solely responsible for ensuring such captures comply with applicable laws and do not infringe upon the rights of others.
9. Data and Privacy
Local-Only Processing
EZcap is designed with privacy as a core principle. The Software operates entirely on your local device without any internet connectivity for its core functions:
- No Data Collection: We do not collect personal information, screen captures, usage statistics, or any other user data
- No Data Transmission: No information is sent to our servers, third-party services, or any external destinations
- Local Storage Only: All captured screenshots remain on your device under your exclusive control
- No Tracking: We do not track your usage, behavior, or activities
System Access vs. Data Collection
While the Software requires certain system permissions to function (as detailed in Section 4), these permissions are used solely for providing screen capture functionality. Requiring access to your screen, clipboard, and file system does not mean we collect this information. Think of it this way: EZcap needs permission to see your screen to capture it, just like a camera app needs permission to access your camera—but we don't record, store, or transmit what we access beyond what you explicitly choose to capture and save locally.
The End User is solely responsible for the storage, management, security, and disposal of captured content.
10. Disclaimer of Warranties
THE SOFTWARE IS PROVIDED "AS IS" AND WITHOUT WARRANTY OF ANY KIND. THE COMPANY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A SPECIFIC PURPOSE, AND NON-INFRINGEMENT.
The End User acknowledges that:
- Screen capture quality may vary based on system configuration and display settings
- The Software may include errors or may not function as intended under all circumstances
- Capture functionality depends on system resources and compatibility factors beyond our control
- The Company makes no warranties regarding the accuracy, completeness, or quality of captured content
- The End User is solely responsible for verifying captured content meets their requirements
11. Limitation of Liability
To the maximum extent permitted by law, the Company's total liability under this Agreement shall not exceed the actual amount paid by the End User for the Software. Under no circumstances shall the Company be liable for indirect, incidental, consequential, or punitive damages, including but not limited to loss of data, loss of captured content, loss of profits, or business interruption, even if previously advised of their possibility.
Some jurisdictions do not allow the exclusion or limitation of liability for certain types of damages, so the above limitations may not apply to you in full. In such cases, the Company's liability shall be limited to the maximum extent permitted by applicable law.
12. Updates and Support
The Company may, at its discretion, issue updates or upgrades that alter functionality, fix defects, improve performance, or enhance screen capture capabilities. The End User consents to the automatic installation of such updates when available. The Company reserves the right to cease supporting earlier versions at any time, with or without notice.
13. Termination Clause
This Agreement shall remain in effect until terminated by either party. The End User may terminate this Agreement by uninstalling the Software and ceasing use. The Company may terminate the license immediately for any violation of its terms. Upon termination, all rights granted to the End User shall revert, and all associated files must be permanently removed from all devices.
14. User Indemnification
The End User agrees to indemnify and defend the Company and its affiliates, officers, and employees against any claims, liabilities, or expenses—including legal fees—arising from misuse of the Software, violation of this Agreement, unlawful capture or distribution of protected content, or any privacy or copyright violations resulting from the End User's use of screen capture capabilities.
15. Amendments and Modifications
The Company reserves the right to modify this Agreement at any time. Updates will be posted on the Company's website or within the Software interface. Continued use of the Software following such changes constitutes acceptance of the revised terms. The End User is encouraged to review this Agreement periodically.
16. Severability and Assignment
If any provision of this Agreement is deemed invalid or unenforceable, the remaining provisions shall continue in full force. The End User may not assign or delegate any rights under this Agreement without prior written approval from the Company.
17. Governing Law and Jurisdiction
This Agreement shall be governed by the laws of the State of Israel. All legal disputes shall be adjudicated exclusively in competent courts located in Tel Aviv, Israel. Any claim must be filed within one (1) year of the occurrence giving rise to the dispute.
18. Force Majeure
The Company is not responsible for any failure to perform resulting from causes beyond its reasonable control, including natural disasters, power outages, acts of war, civil disturbances, technical malfunctions, labor disputes, or governmental restrictions.
19. Acknowledgment and Acceptance
By installing, accessing, or using EZcap, you acknowledge that you have read this Agreement, understand it, and agree to be bound by its terms and conditions. You also acknowledge that this Agreement constitutes the complete agreement between you and the Company regarding the Software.
